TIMELINE

Casalinova Photography LLC (referred to as Casalinova Photography in this document) will ask for a nonrefundable deposit to secure a booking date. Payment must be paid in full at the time of shoot unless agreed on present to the shoot date. Casalinova Photography may take up to two weeks to post a sneak peek and may take six to eight weeks to edit and upload photos to their website for viewing and/or download, depending on the purchased package.

Shipping and Handling

Casalinova Photography is not responsible for lost or damaged merchandise. Photos my take up to 3-4 weeks to process and to receive by mail in the United States. Photos may take up to 5 weeks to process and receive by mail in Canada. Casalinova Photography is not responsible for keeping tracking information. If buyer wishes to have tracking added to their shipping, a tracking number will be emailed to them when their order is fulfilled and shipped.

COPYRIGHT AND REPRODUCTION

All copyrights and/or intellectual property rights for all photographs taken at the session shall be held exclusively by Casalinova Photography LLC. Casalinova Photography’s photos may not be printed with out the photographers written consent. The client may post images online and to social media (i.e. Facebook, Instagram, etc.) but must note Casalinova Photography as the photographer and include a tag where feasible. If a gallery is posted online, the client is encouraged to back up their images upon receiving them. Your purchase of the original files releases Casalinova Photography from any liability due to loss or damage of the images, and also releases Casalinova Photography from any obligation to maintain copies of any digital file, image, or photograph. The client may not sell, distribute or take credit for any of the photos taken by Casalinova Photography. Casalinova Photography highly recommends that photographs be printed only through Casalinova Photography.  Casalinova Photography is allowed to refuse service to anyone with or without evidence of making their own copies.

GENERAL PHOTOGRAPHY RELEASE 

Casalinova Photography is authorized to publish photographs taken and names for use of Casalinova Photography’s print, online and video- based marketing materials. Casalinova Photography is hold harmless from any reasonable expectation of privacy or confidentially associated with the images specified above. No one will not receive financial compensation of any type associated with the taking or publication of these photography or participation in compensation of any type associated with the taking or publication of these photographs or participation in company marketing materials or other company publications. Publication of said photos confers no right of ownership or royalties whatsoever. 

By being photographed: Casalinova Photography, its contactors, its employees, and any third parties involved in the creation or publication of marketing materials, is released from liability for any claims by me or any third party in connection with my participation. 

MODEL RELEASE

Casalinova Photography has the absolute and irrevocable right and permission, in respect to the photographs, video tapes, motion pictures, recordings, or any other media (hereinafter collectively known as “Images”) that Casalinova Photography has taken of my property, or minors in my care, or in which I may be included with others, to copyright the same, in Casalinova Photography own name or otherwise, to use, re-use, publish, re-publish, post, display, in printed form, or in any and all media now or hereafter known, and for any legitimate purpose whatsoever. Casalinova Photography has the right to use and publish images and photographs taken at photography session to further promote its service, including portfolio, print, web site, display, advertisement, and editorial use. Casalinova Photography agrees to limit the use of these images and photographs to promotional use only. Casalinova Photography may revoke this license at any time and for any reason. Casalinova Photography retains all copyrights to the images and derivative works thereof. 

WAIVER OF LIABILITY RELEASE

By agreeing to a photography session with Casalinova Photography, client is waiving, releasing, and discharging Casalinova Photography and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to anyone during the envent; including my traveling to and from this event. Casalinova Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against Angela Casalinova or Casalinova Photography for any reason. Casalinova Photography is not responsible for uncooperative parties. It is understood that the behavior of children is unpredictable, however, photographer is not liable if children.

EQUINE/ LIVESTOCK/ PET USEAGE

Under Ohio Law, Section 2305.321 | Certain equine activities no liability, An equine activity sponsor or professional shall not be liable for any injury to, or the death of a participant in equine activities resulting in equine activities resulting from inherent risk of equine

I recognize the inherent risks involved in riding and working with and near any live animal include but are not limited to:

·        Bites, kicks, abrasions, or contusions from animal

·        Being thrown or bucked off horses

·        Scratches or injury from stalls or enclosures

·        Scratches or other injury from grooming or handling equipment and tack

·        Allergic reactions to animals, hay, or other allergens.

·        Tripping in holes, material, and equipment.

·        Slipping, falling, or otherwise being injured in the barn, in stalls, or on the ground which can be slippery, muddy, wet, or contain present other hazards

By hiring or buying any product from Casalinova Photography, you are agreeing to the terms laid out above.
